Data Subject Request Form

How to apply in order to exercise your rights under Article 11 of the Turkish Personal Data Protection Law.

Article 11 of Law No. 6698 on the Protection of Personal Data grants data subjects a number of rights in relation to their personal data. This page explains, within the framework of the Communiqué on the Procedures and Principles of Application to the Data Controller, how you may apply to us in order to exercise those rights.

Your Rights Under the Law

  1. to learn whether your personal data is being processed,
  2. to request information if it has been processed,
  3. to learn the purpose of processing and whether the data is used in accordance with that purpose,
  4. to know the third parties, in Türkiye or abroad, to whom it has been transferred,
  5. to request its correction if it has been processed incompletely or inaccurately,
  6. to request its erasure or destruction within the conditions set out in the Law,
  7. to request that correction, erasure and destruction operations be notified to the third parties to whom the data has been transferred,
  8. to object to an adverse outcome arising from analysis carried out by automated systems,
  9. to claim compensation if you suffer loss because of unlawful processing.

Information Your Application Must Contain

So that your application can be assessed, Article 5 of the Communiqué requires the following information to be included:

  • your first name and surname, and your signature if the application is in writing,
  • your Turkish identity number if you are a citizen of the Republic of Türkiye; your nationality, passport number or identity number if you are a foreign national,
  • your domicile or place-of-business address for the purposes of notification,
  • your e-mail address, telephone number and fax number for notification, if any,
  • a clear statement of the subject of your request,
  • any information and documents supporting your request.

How to Apply

  • Written application: you may deliver your wet-signed petition in person or through a notary to the following address — Taşpazar Mahallesi Mahallesi, Aksaray, 68100 Aksaray, Türkiye
  • Registered electronic mail (KEP): from your registered electronic mail address, using a secure electronic signature or a mobile signature.
  • E-mail: from the e-mail address you have previously notified to us and which is registered in our system, to kardeslermehmetusta@gmail.com.

Stating the subject of your application in the subject line of the e-mail as “Request for Information under the KVKK” helps to speed up the process.

Identity Verification

In order to prevent personal data from being disclosed unlawfully to third parties, we may request additional information or documents to verify the identity of the applicant. Where an application is made through a representative, a power of attorney containing specific authority on the matter must be submitted.

Assessment Period and Fees

Your application will be concluded as soon as possible according to the nature of the request, and in any event within a maximum of thirty days of reaching us. As a rule the response is free of charge. However, if the response exceeds ten pages, a fee may be charged for each additional page, or, if the response is provided on a CD or a similar recording medium, up to the cost of that medium, in accordance with the tariff set by the Personal Data Protection Board.

Form of Response

Your application will be answered in writing or electronically, according to your request. If the request is accepted, it is carried out without delay; if it is rejected, the reasons for the rejection are stated clearly.

Right to Complain

If your application is rejected, if you find the response inadequate, or if no response is given within the prescribed period, you have the right to lodge a complaint with the Personal Data Protection Board within thirty days of learning of the response and in any event within sixty days of the date of your application.

The Turkish version of this text is authoritative; in the event of any discrepancy, the Turkish text prevails.
